Are Arrest Records Public in Wyoming County?
Yes. Wyoming County arrest records are considered public under the New York Freedom of Information Law (FOIL). To this effect, interested individuals can request access to these records from the Wyoming County Sheriff's Office or any local police department within the county. However, certain arrest records are exempt from public access. Per Section 87 of FOIL, these include:

Free Arrest Record Search in Wyoming County
Individuals should contact the Wyoming County Sheriff's Office and local police departments to search Wyoming County arrest records. However, these agencies may charge fees to provide lookup and copying services for arrest records. As alternatives to official sources, interested persons may use third-party sites to search for and lookup Wyoming County arrest records. Most third-party websites provide free public record searches for users. However, because these sites are independently operated, one cannot guarantee the availability of an arrest record of interest and, if available, its accuracy.
How Long Do Arrests Stay on Your Record?
Indefinitely. Arrests remain permanently on record in Wyoming County unless expunged or sealed. As New York State law did not set a time limit for keeping these records, individuals must petition the court to seal or expunge their arrest records. However, this is subject to the eligibility conditions outlined by the law.
Expunge Wyoming County Arrest Records
Under New York's Criminal Procedure Law § 160.50 (5)(a), expungement is restricted to certain marijuana-related offenses. Related arrest records that qualify are automatically deleted (i.e., removed or erased). However, if automatic expungement does not apply, individuals with marijuana-related offense arrest records may petition the court to vacate their convictions, dismiss their charges, or reduce their sentences by filing a "Form CPL 440.46" with the convicting court.
The state uses a sealing process for most other arrest records (i.e., non-marijuana-related offense arrest records). Under the law, sealing may happen automatically without a petition once the arrest satisfies any of the conditions for automatic sealing, which include:
- Non-criminal violation arrests after three years, excluding traffic violations
- Juvenile arrest records
- Arrests ending in acquittal or charge dismissal (CPL §160.50).
Where automatic sealing does not apply (i.e., certain misdemeanor and felony arrest records), persons with such arrest records can petition to seal their arrest records if they have no more than two misdemeanors and one felony conviction after 10 years or have completed a drug treatment program.
Per the Criminal Procedure Law § 160.59, those who qualify and want to submit a petition to seal a misdemeanor or felony arrest record should:
- Submit a “Criminal Certificate of Disposition Request” form to the court and pay the required fee.
- Complete a notarized “Sealing Application” with any supporting documents.
- Send copies of the application, Certificate of Disposition, sealing petition, and supporting documents to the District Attorney’s office. The DA has 45 days to notify the court of any objections.
- File a notarized Affidavit of Service with the DA’s office.
- Submit all original documents, including the Certificate of Disposition, Notice of Motion, Affidavit in Support, and Affidavit of Service, to the court (no filing fee).
The court will decide after receiving and evaluating the petition. If the petition is approved, the court will issue a signed seal order, sealing the created arrest records.
Wyoming County Arrest Warrants
Wyoming County arrest warrants are court-issued orders authorizing law enforcement to arrest, detain, or bring a person before the court. Generally, a judge or magistrate issues a Wyoming County arrest warrant when law enforcement officers provide evidence establishing probable cause that the subject of the warrant has committed a crime. In some cases, a grand jury indictment can trigger the issuance of a warrant. Arrest warrants are also issued if a person fails to appear in court after being summoned.
New York Criminal Procedure Law (CPL) § 120 outlines the guidelines or procedures law enforcement and courts must follow to obtain or issue arrest warrants. Per the law, a valid arrest warrant must include the subject's name or sufficient description, alleged offense, date and time of issue, judge's name and signature, and issuing court.
Law enforcement can execute Wyoming County arrest warrants anywhere in New York State, typically at any time. However, when making an arrest, officers must inform the individual about the warrant, their right to remain silent, and their right to legal counsel.
Do Wyoming County Arrest Warrants Expire?
No. Wyoming County arrest warrants do not expire. Once issued, they remain active until the person named in the warrant is arrested, voluntarily surrenders, or the court recalls the warrant. In Wyoming County, a court may cancel or quash a warrant for reasons like mistaken identity, new evidence proving innocence, the subject's death, or the statute of limitations for the alleged crime has passed.
