Get Genesee County Civil Court Records

Genesee County has several courts that handle civil cases with different levels of jurisdiction. These courts are:

  • The Supreme Court: This court has broad authority over all civil cases. It specifically handles civil cases whose monetary damages exceed $25,000.
  • The County Court: This court has limited authority over civil cases whose monetary damages are $25,000 or less.

Genesee County Marriage Records

Copies of Genesee marriage records are available from the clerk of the town, village, or city where the event occurred. Requests can be made in person during business hours. Individuals who are unable to submit in-person requests can obtain copies of marriage records online, by phone, or by mail from the New York State Department of Health’s Vital Records. The Department only issues Genesee County marriage certificates to spouses and people with a court order or documented legal purpose. Genesee County Divorce Records

The Genesee County Supreme Court is the only court authorized to address divorce cases. The court does not consider divorce documents part of Genesee County public records. It issues an actual divorce judgment to members of the public, but copies of divorce documents can only be obtained by the case parties and their attorneys.

Anyone can use the eCourts’ WebFamily to find divorce information. After locating the portal, click the File/Docket Searches links and select “Genesee-Supreme” from the court dropdown. After choosing the court, enter a file number or docket number. Eligible individuals can get copies of divorce records from the courthouse. The court will only attend to those who submit their requests during business hours (Monday to Friday, 8:30 a.m. to 5:00 p.m.). Basic information about the desired record and a photo I.D. should be provided to access divorce records. Requesters can contact the court by calling (585) 201-5728 to inquire about search and copy fees.

The New York State Department of Health’s Vital Records provides divorce records to case parties and individuals with court orders. It partners with a third-party vendor to issue these records online and by phone for $45. The fee can be paid by Discover, American Express, MasterCard/Visa, or ACH (Electronic Check). The processing time for online and phone orders is 3 and 5 business days. The Department also accepts mail requests for divorce records. The mail package should contain a completed Application for Copy of Divorce Certificate form, a valid I.D., and a check or money order of $30.

Genesee County Birth and Death Records

Residents can obtain copies of Genesee County vital birth and death records in person from the Registrar of Vital Statistics. Alternatively, they can submit requests to the New York State Department of Health’s Vital Records. The Department only issues birth and death records to the following individuals:

  • The subject of records’ parent, spouse, or child
  • A person with a court order
  • The sibling of the deceased
  • The person named on the Genesee County birth certificate.
  • People who have a documented lawful right or claim or medical need (this only applies to death records)

The Department partners with a third-party vendor to issue birth and death records to eligible individuals online and by phone. This service costs $45 plus a processing fee. Mail requesters should complete an Application for Copy of Birth or Death Certificate and send the appropriate form, valid I.D., and a $30 check or money order by first class, registered, certified, or U.S. Priority Mail to the Department.

Genesee County Probate Court Records

All probate cases are filed at the Genesee County Surrogate’s Court, which handles wills, estates, and property of deceased persons. Anyone can visit the courthouse to retrieve copies of these cases. Requests should be made during business hours; a copy fee will be required before the records are released.

Record seekers can freely view and retrieve probate court records online via the WebSurrogate site. The site’s search options are name, file, old index, index book pages, and will. The best place to find property records in Genesee County is at the Treasurer’s Office.
