Fulton County Court Records

Are Court Records Public in Fulton County?
Not all Fulton County court records are public records. While most court records are available to the public in the State of New York, access to some are restricted by state law or court order. The New York Freedom of Information Law (FOIL) does not make provisions for public access to court records. This aspect is governed by Section 255 of the state’s Judiciary Law.
New York does not allow public access to the following types of confidential court records:

Fulton County Criminal Records

Get Fulton County Civil Court Records
Fulton County civil court records are documentations of civil law cases heard in the various courts of the county. These records include the files generated in the county’s Family Court as well as those prepared during probate and small claims cases as well as property, landlord-tenant, and contract disputes.
In Fulton County, Court Clerks’ Offices maintain civil court records. While the Supreme and County Courts have the same clerk, there are different clerks for the county’s Family Court and Surrogate’s Court. All four clerks’ offices are located in the Fulton County Office Building at 223 West Main Street. Fulton County Marriage Records
Marriage records are legal and official documentations of marital unions. In Fulton County, marriage records are not public records. Only the couples named in them, those with relevant needs (such as to claim benefits), and third parties with court orders issued by New York State courts can request copies of Fulton County marriage records. To receive a copy of your marriage certification, download, print, and complete the request form. Fulton County Divorce Records
A Fulton County divorce record is a legal document establishing the dissolution of a marriage. It can either be a divorce decree or a divorce certificate. A divorce decree is a court document available from the Fulton County Family Court. To obtain a copy of this record, simply contact the Clerk of the Family Court.
Fulton County divorce certificates are vital records provided by the county’s clerk as well as the NYS Department of Health. The Fulton County Clerk’s Office provides online access to these records via Search IQS. The Office charges a subscription fee for access to records stored on this portal. Subscribers pay 50 cents per page to print records while non-subscribers pay $5 per page.
The NYS Department of Health can provide copies of divorce records prepared from January 1, 1963 till date. To obtain a Fulton County divorce record from this agency, you must be one of the parties listed on the document or provide a court order authorizing access to the record. Complete the DOH’s Application for Copy of Divorce Certificate and enclose a copy of a valid ID and the required payment, when requesting a Fulton County divorce certificate from the DOH. Fulton County Birth and Death Records
Fulton County birth and death records are official documentations of birth and death events that occurred in the county. These are not public records. Only individuals named on these records, their relatives, and persons with relevant court orders can access these records. Both vital records are available from the state’s Department of Health. Fulton County Probate Court Records
Fulton County probate court records are documents created or presented in the county’s Surrogate’s court relating to the execution of wills and distribution of the estates of deceased individuals. These public records include those involving the probate of wills, estate disputes, and estate and trust administration.
