Bronx County Arrest Records

The New York City Sheriff’s Office (NYCSO) and the New York Police Department (NYPD) are the local law enforcement agencies responsible for preparing and maintaining Bronx County arrest records. These records are generated whenever officers of the sheriff’s office and police department make arrests in the county. They are official records of bookings of individuals apprehended and held in municipal jails in the county.

To access Bronx County arrest records, you must visit or call both the NYPD and NYCSO. To find your arrest records, you may contact the New York Department of Criminal Justice Services (DCJS). This state agency maintains all criminal records for all counties in the State of New York.

After creating arrest records, arrestees may appear before judges in the New York courts with jurisdiction over their offenses. When this happens, court officials create Bronx County court records to document the progress of such cases through the New York judicial system.

Are Arrest Records Public in Bronx County?

Yes. In compliance with the New York Freedom of Information Law (FOIL), law enforcement agencies must provide public access to Bronx County arrest records upon request. However, not all arrest records are available to anyone. For example, Bronx County law enforcement cannot release juvenile arrest records to members of the public. Access to expunged and sealed criminal records, as well as arrest records containing details that may be presented as evidence in active cases, are also restricted.

The DCJS cannot provide Bronx County arrest records. This is because the agency does not allow public access to its criminal records. You can only access your criminal, and arrest, record from the DCJS and not those of a third party.

What Do Public Arrest Records Contain?

When preparing arrest records, Bronx County law enforcement officers must provide the following information:

  • Name, age, gender, and current address of the arrestee
  • Arrest charge
  • Name of the arresting officer and the agency they represent
  • Booking number
  • Where and when the arrest took place

Bronx County Crime Rate

Crime rate statistics for Bronx County are provided by the NY DCJS. The agency publishes annual crime data for all counties in the state and collects these figures from police departments, sheriff’s offices, and probation departments. According to the DCJS, Bronx County recorded 48,720 crimes in 2022. Out of these, 17,592 were violent crimes while 30,678 were property crimes. These figures include 131 murders, 666 rapes, 5,166 robberies, 11,629 aggravated assaults, 2,582 burglaries, 24,044 larcenies, and 4,052 motor vehicle thefts.

Bronx County Arrest Statistics

Bronx County arrest statistics are collated by the DCJS. This agency only reports adult arrests for the counties in New York City because the NYPD does not provide juvenile arrest numbers. In its 2023 report, the DCJS recorded 16,752 felony arrests and 23,003 misdemeanor arrests of adult offenders for Bronx County. Bronx County jail census figures are also not available from the DCJS. However, the Department reported 16,227 individuals in county jails in New York State in 2023 with 6,044 of these in jail facilities within New York City.

Get Bronx County Criminal Records

Bronx County criminal records are official records containing histories of arrests, convictions, and incarcerations in the county. These records are prepared by law enforcement agencies in Bronx County and provided by the DCJS. The State of New York does not allow individuals to request the criminal histories or rap sheets of others. However, residents can request background checks on themselves and obtain their own criminal histories from the DCJS.

The DCJS accepts requests for background checks through IdentoGo, a third-party fingerprinting service provider. To request your criminal record from Bronx County:

  • Visit the IdentoGo website or call (877) 472-6915 to get a fingerprinting appointment scheduled. While making a request for an appointment, choose between obtaining a suppressed (code: 15464Z) or unsuppressed criminal record (code: 15465F). A suppressed criminal history check does not bring up sealed criminal records but an unsuppressed background check includes all criminal records except expunged ones
  • Go to your scheduled IdentoGo fingerprinting appointment with a valid ID. Juveniles submitting criminal history requests must have their parents or legal guardians complete and provide the New York Photo ID Waiver for Minors form
  • Bring the $14.25 fingerprint collection fee to the appointment. You can pay this fee with a credit card or a money order or check made out to “Idemia”

You may wait up to 4 weeks for a response from the DCJS. The Department will send your criminal record to your mail address. If you do not have any criminal history in the State of New York, you will get a “no record” reply.

There is a different set of instructions for contacting IdentoGo for those requesting their Bronx County criminal records from outside the State of New York.

Bronx County Arrest Records Vs. Criminal Records

Arrest records are not the same as criminal records. An arrest record is prepared when an individual is apprehended and booked by a law enforcement office. It is a documentation of the booking event. A criminal record, on the other hand, is a comprehensive history of an individual’s criminal arrest, charge, conviction, and incarceration. While an arrest record may be prepared for a civil offense as well as a criminal one, a criminal record only includes misdemeanor and felony arrests.

A Bronx County arrest record is usually made by local law enforcement agencies such as the NYPD and NYCSO. A Bronx County criminal record also includes the contributions of law enforcement in addition to courts and correctional facilities in the county. When seeking to determine the suitability of applicants for available positions, career advancement, or credit worthiness, institutions like employers, professional bodies, and credit reporting agencies request criminal records rather than arrest records. This is because an arrest record says nothing about whether an arrestee is an offender or not.

How Long Do Arrests Stay on Your Record?

In Bronx County, arrests stay forever on arrestees’ records. The only way to remove them is to seek a court order for record expungement. It is also possible to block access to an arrest record by petitioning the appropriate court to seal it. However, sealed records may still be accessible to law enforcement agencies.

Expunge Bronx County Arrest Records

To expunge a Bronx County arrest record is to completely remove it, as if the record were never created and the arrest never made. In New York State, only a court order or change in state law can expunge a criminal or arrest record. New York courts rarely grant requests for record expungement. However, a large number of arrest and criminal records relating to certain marijuana convictions were automatically expunged in the state due to a change in law and the full legalization of marijuana. These expunged records relate to those involving arrests and convictions of individuals caught in possession of up to 16 ounces of marijuana or sale of up to 25 grams of marijuana

Outside of these marijuana offenses, Bronx County criminal or arrest records are more likely to be sealed than expunged. However, you have to be eligible for criminal record sealing to apply to the court for this action. To have your criminal record sealed in the State of New York, you must have remained crime-free for at least 10 years since your last criminal conviction or release from incarceration. Similarly, you must have no pending criminal case or be the subject of an ongoing criminal investigation. New York also requires that you must have no more than two criminal convictions. This may be for two misdemeanor offenses or a misdemeanor and a felony. Lastly, you must not be required to register as a sex offender under the laws of the State of New York.

If you meet these criteria, you may start the request to have your Bronx County arrest or criminal record sealed by

  • Filling out a Criminal Certificate of Disposition and taking it to the relevant court to approve. You must submit one of this certificate for each case/record you want sealed
  • Pay the $10 court approval fee when submitting the certificate at a Bronx County court. If you are submitting this application to a court outside New York City, you only pay $5
  • Following court approval, fill out and sign a Sealing Application before a notary public
  • Gather and attach any evidence of your rehabilitation to help convince the court to seal your record
  • Make copies of all of these documents and serve them as an application to the Office of the Bronx County District Attorney. You may serve this application by hand or mail
  • Instruct the server to complete an Affidavit of Service and sign it before a notary public
  • Submit original copies of the documents served to the DA’s office to the New York court maintaining the record you wish to seal. Include the signed affidavit of service in your submission

If the sitting judge decides to grant your request, the court will send you a signed Seal Order. You may send a copy of this along with a Request for Seal Verification form to the DCJS to confirm that your arrest or criminal record has indeed been sealed.
